Average annual rent, not total rent

This is the structural difference that makes Delhi cheaper than Maharashtra or Tamil Nadu on a long lease. Most states multiply the monthly rent by the number of months and tax the result. Delhi works from the rent for a single year however long the lease runs.

A flat at fifty thousand a month costs the same to stamp on a three-year lease as on a one-year lease, because both reduce to the same annual figure. In Tamil Nadu the same three-year lease would be taxed on three years of rent plus the deposit. If you are negotiating term length in Delhi, stamp duty is not a reason to keep the agreement short.

Delhi, Noida and Gurgaon are three different rules

People treat Delhi NCR as one market, and for rent it broadly is. For stamp duty it is not. A flat in Dwarka follows Delhi's schedule. The same family moving to Sector 62 in Noida falls under the Uttar Pradesh schedule, and one moving to Golf Course Road in Gurgaon falls under Haryana's. The rates, the registration thresholds and the fees all differ.

Getting the e-stamp

Delhi uses the SHCIL e-stamping system. Certificates are issued at authorised collection centres, which include a large number of bank branches across the city, and can be generated online. You need both parties' names, the property address and the duty amount.

Most short residential agreements in Delhi are executed on an e-stamp certificate and notarised, without going near a sub-registrar. Registration comes into play once the term reaches twelve months, and carries a flat fee rather than a percentage.

Common mistakes in Delhi

  • Using a Noida or Gurgaon figure for a Delhi property, or the reverse.
  • Multiplying the rent by the full term. Delhi works off the annual rent.
  • Assuming notarisation and registration are interchangeable.
  • Buying the certificate in a name that does not match the parties on the deed.

Stamp duty city by city in Delhi

The rate is set by the state, so it does not change from one city to the next. What changes is local practice — deposit sizes, whether people register, and which office has jurisdiction. Jump to South and Central Delhi, Dwarka, Rohini and West Delhi, Noida and Greater Noida, Gurgaon and Faridabad.

South and Central Delhi

Higher rents in Defence Colony, Greater Kailash and the Hauz Khas belt push the annual rent figure up, and since Delhi taxes the annual rent rather than the whole term, that is what drives the duty. Deposits here run two to three months and sit largely outside the calculation, which is why a Delhi bill on a large deposit looks small next to a Chennai one.

Dwarka, Rohini and West Delhi

The same schedule applies across the territory, so the only variable is the rent. Society and RWA paperwork in the Dwarka sectors commonly asks for the agreement plus police verification, neither of which affects the duty but both of which take time — start them before the move-in date rather than after.

Noida and Greater Noida

Not Delhi. Noida falls under the Uttar Pradesh stamp schedule, with its own rate and its own registration thresholds, so the figures on this page do not apply. It is the single most common mistake people make when renting across the NCR, usually because the flat is a twenty-minute drive from a Delhi one.

Gurgaon and Faridabad

Also outside Delhi — these follow Haryana's schedule. Gurgaon in particular has high rents and heavy corporate lease activity, and the duty there is calculated on a different basis from the one shown here. Check the Haryana rate before signing.

What does average annual rent mean for a Delhi lease?
It is the rent for one year rather than for the entire term. A longer lease is reduced to an annual figure before the rate is applied, so term length affects duty much less here than elsewhere.
Is the stamp duty the same in Noida and Gurgaon?
